We have been instructed by the National Union of Professional Foster Carers (“NUPFC”) to pursue claims on behalf of three members to apply to the Employment Tribunal to try and employment status for foster carers. NUPFC is a unique, specialised trade union representing the interests of foster carers. Claims for whistleblowing, race discrimination, age discrimination, unpaid holiday, and various other claims have been issued. The claims are currently being case managed by the Employment Tribunal. We have made an application to consolidate all three claims. These claims will likely go to the Supreme Court to try and overturn a Court of Appeal case which says that foster carers do not work under a contract and thus do not have employment rights. Further, an update to follow.
